These Terms and Conditions (“Terms”) govern your access to and use of the Cutco service (“Cutco”, “we”, “us”, “our”). By using Cutco, you agree to these Terms.

1. Nature of the Service

Cutco is an automated energy optimisation service designed to help Australian households monitor energy plans, identify potential savings, and facilitate switching between retailers.

Cutco is not an energy retailer, broker, or supplier. We do not generate, sell, or distribute electricity or gas. We do not control pricing, billing, outages, or the conduct of any energy retailer. Our service is limited to providing tools, automation, and data-driven insights to assist you in making and executing switching decisions.

2. Use of Automation and Authority

Cutco operates using automated systems to reduce the effort required to manage energy plans. Where you enable switching or related features, you expressly authorise Cutco to initiate actions on your behalf for the purpose of facilitating a switch.

This may include submitting forms, interacting with retailer systems, and using system-generated or virtual communication channels such as email addresses or phone numbers where required to complete a switching process.

You acknowledge that:

  • these actions are carried out through automated workflows;
  • they may involve third-party systems outside our control; and
  • outcomes depend on those systems accepting and processing the request.

By enabling these features, you consent to the use of automation and accept that you retain ultimate responsibility for decisions made using the service.

3. Scope and Limitations

Cutco’s role is strictly limited to monitoring, reporting, and facilitating switching.

Cutco does not:

  • manage your ongoing relationship with your energy retailer;
  • handle billing enquiries, disputes, or complaints;
  • address outages, faults, or service interruptions;
  • provide financial, legal, or consumption advice;
  • guarantee access to any specific plan or retailer.

All matters relating to your energy supply, billing, and service remain between you and your energy retailer.

4. Data Sources and Accuracy

Cutco relies on information sourced from government platforms, energy retailers, and other public or third-party data providers. While we take reasonable care in processing and presenting this data, the energy market is dynamic and information may be incomplete, inaccurate, or out of date.

Any comparisons, rankings, or savings estimates provided by Cutco are indicative only. They are based on available data and assumptions and may not reflect actual outcomes.

Cutco does not guarantee the accuracy, completeness, or suitability of any data or recommendation.

5. Customer Responsibilities

You are responsible for:

  • providing accurate, complete, and current information;
  • reviewing any recommendations before proceeding;
  • paying all energy bills and maintaining your account in good standing;
  • managing your energy usage and consumption;
  • complying with the terms of your chosen energy retailer.

Cutco does not assume responsibility for your financial obligations or your relationship with your retailer.

6. Fees and Access

Certain features of Cutco, including automated switching and ongoing monitoring, may require payment of a subscription or service fee. Access to these features is conditional on payment.

If fees are not paid when due, we may suspend or restrict access to premium functionality. Any applicable fees will be disclosed prior to subscription.

7. Automation Risks and Shared Responsibility

Cutco uses automated systems to perform tasks on your behalf. While we take reasonable care in designing, maintaining, and reviewing these systems, you acknowledge that:

  • automated processes may fail, be delayed, or produce unintended outcomes;
  • third-party systems (including retailer platforms) may reject, alter, or not process requests;
  • switching may not occur as expected, or may not occur at all.

By choosing to use Cutco’s automated features, you accept that the service involves shared risk. Cutco undertakes to operate its systems with reasonable care and to apply monitoring and quality assurance processes. However, you agree that you bear responsibility for decisions made using the service and for the consequences of those decisions.

8. No Guarantee of Savings or Outcomes

Cutco aims to identify opportunities to reduce energy costs, but we do not guarantee that:

  • a switch will result in savings;
  • a recommended plan is the best available option;
  • any switch will be completed successfully or within a particular timeframe.

Actual outcomes depend on market conditions, retailer policies, and your individual usage.

9. Limitation of Liability

To the maximum extent permitted by law, Cutco’s liability for any loss, damage, or expense arising from your use of the service is limited.

We are not liable for indirect, incidental, or consequential loss, including loss arising from increased energy costs, failed or delayed switching, reliance on inaccurate data, or actions of third-party retailers.

Nothing in these Terms excludes or limits rights you have under the Australian Consumer Law, including guarantees that cannot be excluded. Where liability cannot be excluded, it is limited (at our option) to:

  • re-supplying the service; or
  • refunding the fees paid for the relevant service.

10. Indemnity

You agree to indemnify and hold Cutco harmless from any claims, losses, or liabilities arising from:

  • your use of the service;
  • your breach of these Terms;
  • inaccurate or incomplete information you provide;
  • any dispute between you and an energy retailer.

This clause does not apply to the extent that loss is caused by our failure to comply with non-excludable obligations under applicable law.

11. Consent and Withdrawal

You may withdraw your consent to automated actions at any time by disabling relevant features or ceasing use of the service. Withdrawal of consent may limit or prevent Cutco from providing key functionality.

12. Privacy

Your use of Cutco is subject to our Privacy Policy, which explains how we collect, use, and store your information in accordance with applicable Australian privacy laws.

13. Service Availability and Changes

We may update, modify, suspend, or discontinue any part of the service at any time. We do not guarantee uninterrupted or error-free operation.

14. Governing Law

These Terms are governed by the laws of Australia. Any disputes arising in connection with these Terms will be subject to Australian jurisdiction.
